End User License Agreement

1. Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and SwiftTunnel ("Company," "we," or "us") for the use of SwiftTunnel software and services ("Software").

BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.

2. License Grant

Subject to your compliance with this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and use the configuration files generated through our Service
  • Connect to our servers using the SwiftTunnel desktop application
  • Use the Service for personal, non-commercial purposes

3. License Restrictions

You may NOT:

  • Copy, modify, or distribute the Software or any part thereof
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
  • Remove or alter any proprietary notices, labels, or marks on the Software
  • Sublicense, lease, rent, loan, or sell the Software or access to it
  • Share your configuration files or credentials with third parties
  • Use the Software to develop competing products or services
  • Use the Software in any way that violates applicable laws or regulations
  • Use automated systems or bots to access or interact with the Software
  • Circumvent any technical measures designed to control access to the Software

4. Intellectual Property

The Software and all copies thereof are proprietary to the Company and title thereto remains in the Company. All rights in the Software not specifically granted in this EULA are reserved to the Company. The Software is protected by copyright and other intellectual property laws and treaties.

SwiftTunnel, the SwiftTunnel logo, and other SwiftTunnel trademarks, service marks, graphics, and logos used in connection with the Software are trademarks of the Company. Other trademarks, service marks, graphics, and logos used in connection with the Software may be the trademarks of their respective owners.

5. Third-Party Software

The Service utilizes the following third-party technologies:

  • Tauri: An open-source framework used for the desktop application
  • Windows Packet Filter: Network driver used for split tunneling functionality

Your use of third-party software is subject to their respective license agreements. We are not responsible for any third-party software.

6. Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • Keeping your configuration files and private keys secure
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized use of your account

If you believe your account has been compromised, you should immediately regenerate your configurations and change your account password.

7. Updates and Modifications

The Company may update, modify, or discontinue the Software at any time without notice. Updates may be required for continued use of the Service. By using the Software, you agree to receive such updates. The Company has no obligation to provide updates or to continue making the Software available.

8. Data Collection

Our data collection practices are described in our Privacy Policy. By using the Software, you consent to the collection and use of information as described therein.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THE COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING:

  • The accuracy, reliability, or completeness of the Software
  • The results that may be obtained from using the Software
  • Any specific latency improvements or connection speeds
  • Compatibility with any particular game, application, or system

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Software
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your data or configurations
  • Any game bans, restrictions, or penalties resulting from use of the Software
  • Any other matter relating to the Software

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of this EULA or your use of the Software.

12. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations. You shall not export, re-export, or transfer the Software to any prohibited destination, entity, or person without proper government licenses or authorizations.

13. Termination

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination:

  • You must cease all use of the Software
  • You must delete all configuration files
  • The Company may deactivate your access
  • Provisions that by their nature should survive termination will survive

14. Governing Law and Dispute Resolution

This EULA shall be governed by and construed in accordance with applicable laws, without regard to principles of conflict of laws. Any dispute arising out of or relating to this EULA shall be resolved through binding arbitration in accordance with the rules of a mutually agreed upon arbitration body.

15. Severability

If any provision of this EULA is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and the Company regarding the Software and supersedes all prior agreements and understandings, whether written or oral.

17. Amendments

The Company reserves the right to modify this EULA at any time. We will notify you of material changes by posting the updated EULA on our website. Your continued use of the Software after such changes constitutes acceptance of the modified EULA.
